1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of the Calm Nic website and online store (the “Site”), including any purchase you make through it. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Age Restriction & Eligibility to Purchase

The products sold on this Site are nicotine pouches and are age-restricted. By using this Site or placing an order, you confirm that:

• You meet the minimum legal age to purchase and use nicotine products in your province or jurisdiction; and
• You are purchasing for your own personal use, not for resale, and not on behalf of anyone who does not meet that legal age requirement.

We rely on your confirmation at the time of purchase. We reserve the right to refuse, cancel, or delay any order where we have reason to believe this requirement has not been met.

3. Order Acceptance & Pricing

All orders are subject to acceptance and availability. Placing an order and receiving an order confirmation does not guarantee that the order will be fulfilled – we may refuse or cancel any order, including after confirmation, for reasons such as product unavailability, suspected fraud, pricing errors, or eligibility concerns under Section 2.

Prices on the Site are listed in Canadian dollars (CAD) and are subject to change without notice. In the event a product is listed at an incorrect price due to a typographical or technical error, we reserve the right to cancel any order placed at the incorrect price, whether or not the order has been confirmed.

4. Payment Terms

Payment is processed at the time of order through our third-party payment provider, PayPal (including credit and debit card payments processed via PayPal). By submitting payment information, you represent that you are authorized to use the payment method provided. We do not store your full payment card details on our servers.

You are responsible for ensuring the billing information you provide is accurate and current. Orders may be delayed or cancelled if payment cannot be verified or is declined.

5. Returns & Refunds

Returns, exchanges, and refunds are governed by our Refund and Returns Policy, which forms part of these Terms. Please review that policy for full details before requesting a return.

6. Limitation of Liability

To the fullest extent permitted by law, Calm Nic and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any product purchased through it, including but not limited to loss of use, loss of data, or loss of profits, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of the Site or a purchase made through it will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

Nicotine products carry inherent health risks. Use of any product purchased through this Site is at your own discretion and risk, and in accordance with the manufacturer’s instructions and applicable law.

7. Governing Law

These Terms are governed by, and will be interpreted in accordance with, the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

We may update these Terms from time to time. Changes take effect once posted to this page, and the “Last updated” date above will reflect the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
